Possession of cannabis by individuals 21 years of age or older is a misdemeanour and is punishable by a fine of $600 or possible drug treatment. For a second violation, the fine raises to $1,000. For a third violation, the punishment is up to one year imprisonment and a fine of up to $2,000. A fourth violation changes the classification to a felony and is punishable by 1 - 4 years imprisonment and a fine of up to $5,000.


Possession of cannabis by individuals under 21 years of age of less than one ounce of marijuana is a felony, punishable by 1 - 4 years in prison and a fine of up to $5,000. Probation is generally granted in lieu of imprisonment for first and second violations, for third offences, there is a presumption of imprisonment.


Production, delivery or sale of less than 100 pounds of cannabis is punishable by 1 - 6 years in prison and a fine of up to $20,000 for the first offence. For a second violation, the penalty raises to 2 - 10 years in prison and a fine up to $20,000. For a third or subsequent violation, the penalty raises to 3 - 15 years in prison and a fine up to $20,000. Production, delivery or sale of 100 pounds or more is punishable by up to five years imprisonment and a fine up to $25,000. For quantities of 2,000 pounds or greater, the penalty rises to 2 - 20 years in prison and a fine up to $50,000. For quantities greater than 10,000 pounds the penalty can be up to life imprisonment, with the possibility for parole after a minimum of five years and a fine up to $200,000.


It is an affirmative defence to any charge of possession, delivery or production of cannabis that the individual is engaged in the medical use of marijuana if the amount is no more than one ounce of usable marijuana, three mature plants or four immature plants.


Any sale to a minor resu1ts in 1 - 20 years in prison for the first violation, and up to life for a second violation. Sale within 1,000 feet of a school, video arcade, public pool or youth center doubles the possible sentence.


Possession of paraphernalia results in up to six months imprisonment and a fine up to $1,000. Sale of paraphernalia results in 1 - 4 years imprisonment and a fine up to $5,000.
